Terms of Service

1. Acceptance of Terms

By accessing or using InstaSPY ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.

By creating an account, starting a subscription, or completing a payment, you confirm that you have read, understood, and accepted these Terms.

2. Description of Service

InstaSPY is a web-based platform that allows users to view publicly available Instagram stories, highlights, posts, and reels through our interface.

The Service provides tools that enable anonymous viewing and related features.

InstaSPY is an independent service and is not affiliated with, endorsed by, or connected to Instagram, Meta, or any related company.

All trademarks and brand names belong to their respective owners.

3. Public Accounts and Public Content Only

The Service works exclusively with public Instagram accounts. Content from private accounts cannot be viewed, retrieved, downloaded, or tracked through InstaSPY under any circumstances.

If an Instagram account is set to private — or is switched to private at any time — the Service will not be able to display its stories, highlights, posts, reels, or follower data. This is a technical and deliberate limitation of the Service, not a malfunction.

InstaSPY does not bypass, circumvent, or attempt to defeat privacy settings, does not access private accounts, does not use login credentials belonging to other people, and does not store private content. Any expectation that the Service can access private accounts is expressly disclaimed.

You acknowledge that a subscription grants access to the Service's tools and features — not to any specific account's content. The inability to view a private account, or an account that becomes private or is deleted, does not constitute a failure of the Service and does not entitle you to a refund, credit, or compensation of any kind.

Users are solely responsible for how they use the Service and must comply with applicable laws and regulations.

4. User Accounts

To access certain features of the Service, users may be required to create an account.

You agree to:

• Provide accurate and complete registration information
• Maintain the security of your login credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription and Billing

Certain features of InstaSPY require a paid subscription.

By purchasing a subscription, you agree to pay all fees associated with your selected subscription plan.

Subscriptions may automatically renew at the end of the billing cycle unless canceled prior to the renewal date.

Trial Period

Some subscription plans may include a 3-day trial period.

When activating a subscription that includes a trial:

• The payment method provided may be charged immediately upon activation of the subscription.
• The trial period refers to additional access time granted to evaluate the service.
• The 3 free trial days are added to the subscription access period.

By completing the checkout process you confirm that:

• You understand the pricing and billing terms of the subscription
• You authorize the payment charge through the third-party payment processor used by the Service
• You approve the activation of the subscription and associated billing

Payment Processing by a Third-Party Provider

All payments are processed exclusively by an external, independent payment provider (currently Dodo Payments, and previously PayPal for legacy subscriptions). InstaSPY does not collect, process, or store your card details or any other payment credentials at any stage.

The payment transaction itself — including authorization, currency conversion, fraud screening, applicable taxes (VAT/GST/sales tax), receipts, and the security of your payment data — is performed by and is the sole responsibility of that payment provider, in accordance with its own terms of service and privacy policy, which apply to you in addition to these Terms.

Your billing statement may show the name of the payment provider or its merchant of record rather than InstaSPY. Recurring charges are initiated and executed through the provider based on the plan you selected.

InstaSPY is not liable for declined transactions, processing delays, currency or exchange-rate differences, additional bank or card issuer fees, or any other act, omission, or technical failure attributable to the payment provider or to your bank or card issuer. Any claim regarding the execution or security of the payment transaction itself should be directed to the payment provider; claims regarding access to the Service should be directed to InstaSPY support.

6. Cancellation and Refund Policy

Strict No-Refund Policy

All payments are final. No refunds will be issued under any circumstances, for any reason, without exception. This includes, but is not limited to:

• Dissatisfaction with the Service or its features
• Failure to use the Service during the subscription period
• Forgetting to cancel before a renewal date
• Changes in personal circumstances or needs
• Technical issues on the user's end (device, browser, internet connection)
• Misunderstanding of the subscription terms or pricing
• Service downtime, interruptions, or temporary unavailability
• Any other reason not listed above

This no-refund policy applies to all payment types including first payments, recurring renewals, one-time purchases, and trial activations. There are no partial refunds, pro-rated refunds, credits, or exceptions of any kind.

It also applies where a specific Instagram account cannot be viewed because it is private, has been switched to private, has been deleted, or has restricted its content — as described in Section 3. Your subscription pays for access to the Service and its features, not for access to any particular account's content.

No refund request will be considered, reviewed, or granted, regardless of how soon after purchase it is submitted. Cancelling your subscription stops future charges only — it does not refund any amount already paid.

Cancellation Policy

You may cancel your subscription at any time through your account settings or by contacting our support. Upon cancellation:

• Your subscription will remain active until the end of the current billing period you have already paid for
• You will continue to have full access to all features until that date
• After the paid period ends, your account will revert to the free plan
• No further charges will be made after cancellation takes effect
• Cancellation does not entitle you to a refund for the current or any previous billing period

3 Bonus Access Days on Monthly Plans

As a courtesy, when you manually cancel a monthly subscription plan through your account, InstaSPY grants you 3 additional bonus days of full access beyond the end of the billing period you have already paid for. No payment is charged for these bonus days.

• This benefit applies only to monthly plans. It does not apply to weekly plans, trial plans, or yearly plans.
• It applies only to a cancellation you initiate yourself. It does not apply to subscriptions that expire, lapse due to a failed payment, or are terminated by InstaSPY for a breach of these Terms.
• The 3 bonus days are granted once per subscription and are not cumulative or repeatable.
• The bonus days extend access only. They have no monetary value, cannot be redeemed for cash or credit, and cannot be transferred, exchanged, or refunded.
• This is a discretionary courtesy and not a contractual entitlement. InstaSPY may modify or discontinue it at any time without prior notice.

Waiver of Cooling-Off Period

By purchasing a subscription, you expressly acknowledge that the digital service is delivered immediately upon payment, and you therefore waive any right to a cooling-off period or withdrawal right that may otherwise apply under consumer protection laws, to the maximum extent permitted by applicable law.

Chargebacks and Disputes

Filing a chargeback or payment dispute with your bank or payment provider without first contacting InstaSPY support constitutes a violation of these Terms. We reserve the right to immediately suspend or permanently terminate the account of any user who initiates a chargeback. Additionally, we may pursue recovery of any fees, costs, or damages resulting from fraudulent or unjustified chargebacks.

By completing a purchase, you confirm that you have read, understood, and expressly agree to this no-refund policy.

7. Digital Service Delivery

InstaSPY provides digital subscription services and online tools that are delivered immediately upon activation of an account.

Access to the Service is considered delivered once the account is created and access to the platform is granted.

8. Acceptable Use

You agree not to:

• Violate any laws or regulations
• Harass, abuse, or harm others
• Attempt unauthorized access to systems or accounts
• Use bots, scripts, or automated systems to access the Service
• Scrape, copy, or reproduce the Service for commercial purposes
• Impersonate any person or entity

9. Intellectual Property

All content, technology, software, branding, and functionality of the Service are owned by InstaSPY or its licensors and are protected by intellectual property laws.

Users may not copy, reproduce, distribute, reverse engineer, or create derivative works without written permission.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind.

We do not guarantee uninterrupted access, error-free operation, or continuous availability.

11. Limitation of Liability

To the fullest extent permitted by law, InstaSPY shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Service.

12. Indemnification

You agree to indemnify and hold harmless InstaSPY, its operators, employees, and partners from any claims, damages, liabilities, or expenses resulting from your use of the Service or violation of these Terms.

13. Account Suspension or Termination

We reserve the right to suspend or terminate access to the Service at any time if a user violates these Terms or engages in activity that may harm the Service or other users.

14. Communications and Marketing

By creating an account or subscribing to InstaSPY, you expressly consent to receive electronic communications from us, including but not limited to:

• Transactional emails (account confirmations, payment receipts, subscription updates)
• Service-related notifications (feature updates, maintenance alerts, security notices)
• Promotional and marketing messages (special offers, discounts, new features, tips, and recommendations)
• Follow-up and engagement emails related to your use of the Service

These communications may be sent via email or through in-app notifications at our discretion and at any frequency we deem appropriate.

You acknowledge that these communications are part of the Service experience and that your consent is given upon account creation. You may opt out of promotional emails by contacting our support team, but transactional and service-related communications are required and cannot be opted out of while your account is active.

15. Cookies, Tracking, and Analytics

By using InstaSPY, you acknowledge and consent to our use of cookies, tracking pixels, analytics tools, and similar technologies. These technologies are used to:

• Analyze user behavior, traffic patterns, and Service usage
• Improve and optimize the performance and functionality of the Service
• Deliver personalized content and targeted advertising
• Track conversions, referrals, and marketing campaign effectiveness
• Maintain session data and user preferences
• Detect and prevent fraud, abuse, and unauthorized access

We may use third-party analytics and advertising services, including but not limited to Google Analytics, Google Ads, Meta (Facebook) Pixel, and other tracking technologies. These third parties may collect information about your activity on our Service and across other websites and services using cookies, pixels, device identifiers, and similar technologies.

By continuing to use the Service, you consent to the placement and use of cookies and tracking technologies on your device. You may manage cookie preferences through your browser settings, but disabling cookies may affect the functionality of the Service.

16. Changes to Terms

We may update these Terms from time to time.

Continued use of the Service after changes constitutes acceptance of the updated Terms.
