When you open a story inside the Instagram app you are signed in, so Instagram attaches your account to that view and adds your username to the owner's viewer list. The viewer list Instagram shows an account owner only counts views tied to signed-in Instagram accounts, so a server-side fetch has nothing to record there. Your username, your device, and your IP address never reach the account owner, and refreshing the viewer list will not surface you later.

Is it legal to view Instagram stories anonymously?

For public accounts, yes. Instagram's own Terms of Use describe content on a public profile as visible to anyone on the open internet, so loading it without logging in is the same act as visiting the profile in a browser.
